By completing the registration form for the BBC World News Download Centre you agree to the terms set out below.
Definitions
“Affiliate(s)” – licensed distributors of the Channel and/or Channel Programming pursuant to a licence agreement with BBCWN or one of its authorised agents.
“BBCWN” – BBC World News Limited.
The “Channel” – the BBC World News television channel.
“Channel Programming” – programming from the Channel licensed to Affiliate by BBCWN for inclusion in a channel or service owned by the Affiliate.
“Download Centre” – the BBC World News Download Centre.
“BBCWN Content” – the trails and clips made available to Affiliates by BBCWN in the Download Centre.
“Licensed Platform” – the platform or system on which the Affiliate is licensed to distribute the Channel and/or Channel Programming on pursuant to a licence agreement with BBCWN.
General
This site is provided by BBC World News to its Affiliates for the purposes of marketing the availability of the Channel and/or Channel Programming on the Licensed Platform. Use of this website is subject to the BBC Worldwide website Site Terms, Code of Conduct and Privacy Policy. In addition, use of the Download Centre and the content licensed herein is subject to these Terms of Use.
1. Access to Download Centre
The Download Centre is available solely to Affiliates of BBCWN. BBCWN reserves the right to refuse or withdraw access to the Download Centre at any time without notice.
2. Ownership of the site and its contents
This Site is owned by BBCWN. Unless otherwise indicated, all of the content featured or displayed on this Site, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software, and the selection and arrangement thereof is owned by BBCWN or its licensors.
3. Licence
3.1 Subject to these Terms of Use, BBCWN grants you a non-exclusive, non-transferable, royalty free licence to download, store, copy, broadcast and/or transmit the BBCWN Content on any platform owned and/or operated by you for the sole purpose of marketing the availability of the Channel or Channel Programming on your Licensed Platform.
3.2 All rights including intellectual property rights in the BBCWN Content and the Download Centre shall remain the property of BBCWN.
3.3 This licence does not cover use of any BBC World News logo or other BBC trade mark.
4. Use of Clips
4.1 You may not in any way alter or edit the BBCWN Content and each trail shall be broadcast in its entirety.
4.2 You may not use the BBCWN Content in any way that could bring BBCWN and/or the BBC into disrepute or otherwise cause BBCWN and/or the BBC any loss.
4.3 You accept and agree that BBCWN has sole editorial control over all BBCWN Content at all times and it may change or remove any BBCWN Content at its sole discretion. In addition, BBCWN may at any time request that you cease to use any of the BBCWN Content where such use may infringe third party rights.
4.4 If the BBCWN Content is reproduced on a website, you shall post terms and conditions on the website that include restrictions on downloading the BBCWN Content and prohibit republication, retransmission, reproduction or other use of the BBCWN Content.
5. Warranties
5.1 The Download Centre and the BBCWN Content is made available on an "as is" and "as available" basis and BBCWN gives no warranty of any kind in relation to the Download Centre, the BBCWN Content or any content on the BBCWN website. To the maximum extent permitted by law the BBCWN excludes all implied and statutory warranties.
5.2 The BBC has taken reasonable care to ensure that the Download Centre and any related software code contains no errors, viruses or defects, however BBCWN does not warrant that this is the case. You use the Download Centre at your own discretion and risk and you are advised to take all reasonable precautions to protect your computer from virus infection.
6. Liability
To the maximum extent permitted by law BBCWN will not be liable for any loss or damage which you may suffer as a result of or connected to your use of the Download Centre or the BBCWN Content.
7. Indemnity
In the event that a third party commences legal proceedings against BBCWN as a result of your use of the Download Centre in breach of these Terms of Use you agree to indemnify BBCWN in respect of any and all damages, costs and expenses, including reasonable legal fees and litigation expenses, BBCWN suffers or incurs as a result of such action.
8. Compliance and Consents
You will comply with all applicable ordinances, rules and regulations and obtain and pay for all necessary consents, licences, and permissions with respect to your use of the BBCWN Content.
9. Privacy
9.1 By registering for the Download Centre you are consenting to BBCWN processing the personal data that you provide by filling in the registration form or in correspondence between you and BBCWN.
9.2 BBCWN may use information held about you to verify that you are entitled to access the Download Centre as an authorised representative of an Affiliate, to ensure the suitability of the service and to notify you about changes to our service. BBCWN may also use your data to provide you by email with information about services or new programming which may be of interest to you.
9.3 In addition, BBC Worldwide Limited may collect details of your visits to the Website. Any data collected and processed by BBC Worldwide shall be processed in accordance with the BBC Worldwide Privacy Policy and Cookie Policy.
10. Termination
The BBCWN may restrict, suspend or terminate any or all BBCWN Content or your access to the Download Centre and BBCWN Content at any time at its sole discretion without liability.
11. General
11.1 You may not transfer or sublicense any of your rights or obligations under these Terms of Use to any third party.
11.2 This Agreement shall be interpreted in accordance with the laws of England and subject to the exclusive jurisdiction of the English Courts.
11.3 Any failure or delay by BBCWN in exercising its rights under these Terms of Use shall not be construed as a waiver of those rights.
11.4 BBCWN reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and we may send registered users an email notifying you of the change. If any modification is unacceptable to you, you shall stop using the download centre. Your continued use of the download centre following our posting of a change notice or new agreement on our site or receiving our email notifying you of the change will constitute your binding acceptance of the change
